1. Who we are
The website and platform yolisto.app ("Yolisto" or the "Platform") are operated by:

These Terms and Conditions of Use (the "Terms") govern access to and use of the Platform. By accessing Yolisto or using any of its features, you confirm that you have read and accept these Terms. If you do not agree with them, please do not use the Platform.
2. What Yolisto is and what it is not
Yolisto is a technology platform for publishing real estate listings and connecting people interested in properties with the real estate agencies and advisors that list them, with a focus on the Venezuelan market and its diaspora.
It is important that you understand Yolisto's role:
- Yolisto is not a real estate agency or broker. We do not intermediate, negotiate or close purchases, sales, rentals or any other transactions involving properties.
- Yolisto is not a party to any transaction that may arise between you and an agency or any third party. Any negotiation, viewing, reservation, contract or payment takes place outside the Platform and exclusively between the parties involved.
- Yolisto does not provide legal, financial, tax or investment advice. The information available on the Platform, including price estimates, is provided for informational and guidance purposes only.
- Yolisto does not verify property ownership or the content of listings, without prejudice to the moderation measures described in these Terms and in the Listing Rules.
We recommend that, before making any decision regarding a property, you verify the information directly with the advertiser and obtain independent professional advice (legal, notarial, registry or financial, as applicable).
3. Acceptance and changes to the Terms
Use of the Platform implies acceptance of the version of the Terms in force at any given time. The date of the last update appears at the top of this document.
We may amend these Terms to reflect changes in the Platform, in applicable law or in our services. Where changes are significant, we will announce them on the Platform and, for registered users, by email, with reasonable advance notice of at least [30] days before they take effect, unless a legal change requires faster implementation. If you continue using the Platform after the new Terms take effect, you will be deemed to have accepted them. If you do not agree, you may stop using the Platform and, where applicable, request closure of your account.
4. Requirements to use the Platform
To use Yolisto you must be at least 18 years old and have legal capacity to enter into contracts. By using the Platform, you confirm that you meet this requirement.
Basic browsing (property search, viewing listings and content) does not require registration. Certain features, such as the agency panel, require creating an account.
5. Accounts and registration
5.1 Account types
The Platform contemplates two main profiles:
- Users: people searching for properties, browsing information or contacting agencies.
- Agencies: real estate agencies and professional advisors who publish listings through the agency panel.
5.2 Common obligations
When registering, you agree to:
- Provide truthful, accurate and up-to-date information, and keep it current.
- Safeguard your access credentials, which are personal and non-transferable.
- Notify us without delay of any unauthorized use of your account via the contact email in section 1.
- Be responsible for all activity carried out from your account.
5.3 Agency accounts
Agency accounts are reserved for real estate professionals acting in the course of their business. By creating an agency account, you confirm that you act as a professional or on behalf of an agency, and that you hold the necessary authorizations to list the properties you advertise.
We reserve the right to reject registration requests and to request additional information or documentation to confirm an agency's identity and professional status, including, where applicable, any future agency verification program, which will be governed by its own conditions.
6. Publishing listings
Publishing listings is reserved for registered agencies and is governed, in addition to these Terms, by the Listing Rules available on the Platform, which form an integral part of these Terms. The Listing Rules set out, among other things, the requirements applicable to listing content, photographs, prices and conduct.
The advertising agency is solely responsible for the content of its listings, including text, photographs, prices, location, property features and availability. By publishing a listing, the agency represents and warrants that:
- The published information is truthful, accurate and up to date.
- It holds sufficient rights, mandate or authorization from the owner or the relevant party to offer the property and publish its information and photographs.
- The content does not infringe third-party rights or applicable law.
Yolisto may review, moderate, adjust the format of, demote, suspend or remove listings that breach these Terms or the Listing Rules, and may also do so following third-party complaints.
7. Accuracy of information
Listing information is provided by the advertising agencies. Yolisto does not independently verify it and does not guarantee its accuracy, completeness, currency or availability. Published prices, usually expressed in US dollars (USD), are set by advertisers and may change or contain errors.
If you rely on the information in a listing, you do so at your own risk. Before making any decision, verify the information with the advertiser and with the relevant official sources.
If you find a listing that you consider incorrect, misleading or contrary to these Terms, you can report it through [reporting channel pending] or the contact email in section 1.
8. Contacting agencies and leads
When you use a contact form on the Platform to express interest in a property, the details you provide (for example, your name, contact information and message) are transmitted to the agency advertising that property so it can respond to your request. This transmission is disclosed in the form itself.
The processing of your personal data, including this transmission to the advertising agency, is governed by our Privacy Policy, available on the Platform. The agency that receives your data becomes responsible for its own subsequent processing and is bound towards Yolisto to use it only to respond to your request.
Yolisto does not guarantee that an agency will respond to your request or how long it will take to do so.
9. Artificial intelligence features
The Platform includes features based on artificial intelligence, such as natural language search and the USD price estimator, and may include others in the future (for example, a conversational assistant).
These features are governed by the AI Features Notice available on the Platform, which forms part of these Terms. In general:
- AI-generated results, including price estimates, are automated approximations provided for guidance only. They do not constitute an appraisal, a professional valuation or advice of any kind.
- Results may contain errors or inaccuracies and should not be the sole basis for a decision to buy, sell, rent or invest.
- Yolisto does not guarantee that the estimated value of a property will match its actual market price or the price of any eventual transaction.
10. Intellectual property
10.1 Platform and brand
The Platform, its software, design, databases, proprietary text, logos and the Yolisto brand are owned by Ciigma or its licensors and are protected by intellectual and industrial property law. Use of the Platform does not grant you any rights over these elements beyond a personal, limited and revocable right of use for the Platform's own purposes.
Reproduction, distribution, public communication, transformation or extraction of the Platform's content beyond what these Terms or the law permit is prohibited.
10.2 Content published by agencies
Photographs, text and other listing content belong to the advertising agency or its rightful owners. Yolisto does not claim ownership of that content.
By publishing content on the Platform, the agency grants Ciigma a non-exclusive, worldwide, royalty-free and sublicensable license to host, reproduce, technically adapt, display and publicly communicate that content for the purpose of operating, promoting and improving the Platform and its services, including the preparation of aggregated statistics, market reports and price estimates. 11. Prohibited uses
When using the Platform, you agree not to:
- Publish information that is false, misleading or that you have no right to publish.
- Use the Platform for purposes other than real estate search, listing and contact.
- Publish or distribute content that is unlawful, defamatory, discriminatory, offensive or infringing on third-party rights, including any political or proselytizing content.
- Impersonate any person or entity, or misrepresent your affiliation with an agency.
- Use contact details obtained through the Platform for purposes other than the request that originated them, including sending unsolicited communications (spam).
- Carry out bulk data extraction (scraping), or use robots, spiders or other automated means to access the Platform or collect its content, except with Ciigma's express written authorization.
- Use the Platform's content to train artificial intelligence models or to develop products or services that compete with Yolisto.
- Reverse engineer, decompile or attempt to access the Platform's source code, or circumvent its technical security measures.
- Introduce viruses or malicious code, or take actions that overload or damage the Platform's infrastructure.
Breach of this section may result in suspension or closure of your account, in addition to any applicable legal action.
12. Service availability and changes
The Platform is provided "as is" and "as available". Use of the Platform is currently free of charge; we reserve the right to introduce paid services in the future, which will be communicated and governed by their own conditions before they apply.
We work to keep the Platform running properly, but we do not guarantee continuous availability or the absence of errors or interruptions. We may modify, temporarily suspend or withdraw the Platform or any of its features, where applicable with reasonable prior notice, without this giving rise to any right to compensation, except as provided by applicable mandatory law.
13. Account suspension and termination
You may close your account at any time by requesting it through the contact email in section 1 or through the means made available on the Platform.
Ciigma may suspend or close an account, remove listings or restrict access to the Platform in the event of a breach of these Terms or the Listing Rules, well-founded suspicion of fraud or unauthorized use, or where required by law. Measures will be applied in proportion to the seriousness of the breach and, except in cases of urgency or legal impossibility, will be communicated to the affected person together with the reason. The affected person may contact us to present their position through the contact email in section 1.
The sections of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, indemnity and governing law) will continue to apply after the account is closed.
14. Limitation of liability
Nothing in these Terms excludes or limits Ciigma's liability in cases where the law does not allow it to be excluded or limited, including willful misconduct and the mandatory rights you hold as a consumer.
Subject to that:
- Ciigma is not responsible for the content of listings or for the conduct of agencies or users. Responsibility for listings lies with the advertising agency.
- Ciigma is not a party to transactions between users and agencies and is not responsible for their negotiation, conclusion, performance or outcome, or for any payments, deposits or deliveries the parties agree outside the Platform.
- Ciigma is not responsible for decisions you make based on information from the Platform, including price estimates and other AI-generated results.
- Ciigma is not liable for indirect damages, loss of profit or loss of opportunity arising from the use of, or inability to use, the Platform.
- With respect to content hosted on behalf of agencies, Ciigma acts as an intermediary service provider and will apply the liability regime provided by applicable law, diligently removing unlawful content of which it has actual knowledge.
While the service is free of charge, and to the extent permitted by law, Ciigma's total liability towards a user for claims arising from use of the Platform will be limited to [cap amount or criterion to be defined with counsel].
15. Indemnity
You agree to hold Ciigma harmless from third-party claims, including reasonable defense costs, arising from: (a) content you publish on the Platform; (b) your breach of these Terms or applicable law; or (c) your disputes with other agencies, users or third parties arising from contacts or transactions originated through the Platform. This obligation applies to the extent permitted by mandatory consumer protection law.
16. Third-party links and services
The Platform may include links to third-party sites and rely on third-party services (for example, mapping or messaging services). Those sites and services are governed by their own terms and policies, over which Ciigma has no control and assumes no responsibility.
17. Governing law and jurisdiction
These Terms are governed by Spanish law.
For any dispute arising from these Terms or from use of the Platform:
- If you act as a consumer, you may bring proceedings before the courts of your place of domicile, and you will in any case retain the protection granted by the mandatory rules of the country of your habitual residence, of which these Terms cannot deprive you.
- If you act as a professional or business (including agencies), the parties submit to the courts of the city of Madrid (Spain), waiving any other forum to which they might be entitled.
Before resorting to the courts, the parties will seek to resolve the dispute amicably by contacting the email address in section 1.
18. Contact and notices
You can contact us at legal@yolisto.app or at the address indicated in section 1.
Notices from Ciigma to you will be delivered through the Platform or to the email address associated with your account. It is your responsibility to keep that address up to date.
19. Final provisions
- If any clause of these Terms is declared void or unenforceable, the remainder will remain valid.
- Ciigma's failure to exercise any right under these Terms does not constitute a waiver of that right.
- You may not assign your position under these Terms without Ciigma's prior consent. Ciigma may assign its position in the context of a corporate reorganization or business transfer, informing users where required by law.
- These Terms, together with the Privacy Policy, the Cookie Policy, the Listing Rules and the AI Features Notice, constitute the entire agreement between you and Ciigma regarding use of the Platform.
